1. ACCEPTANCE OF TERMS

The use of this Website is governed by the Terms & Conditions outlined herein. By visiting, dealing, transacting, or otherwise using this Website, you acknowledge that you have read, understood, and unconditionally accepted these Terms & Conditions. These terms constitute a legally binding agreement between Akinfo Tools Private Limited ("Company") and the User. If you do not agree with these Terms & Conditions, you must cease any dealings or transactions on this Website. By expressly or implicitly accepting these Terms, you also agree to abide by the Company's policies, including the Privacy Policy, as updated from time to time.

2. ABOUT THE SERVICE

Akinfo Tools Private Limited operates an online store supplying mobile phone spare parts, repair tools and related equipment to trade and business customers, through the website https://akinfotools.com/ and the AKINFO Tools mobile application.

3. ELIGIBILITY

  1. Any individual above 18 years of age, transacting in a legally acceptable currency, and competent under the Indian Contract Act, 1872, may use this Website. If you are not eligible, you are prohibited from transacting or using the Website.
  2. Users are responsible for maintaining the confidentiality of their display names and passwords and are accountable for all activities under their accounts, including unauthorized use by minors. Users warrant that the information provided (name, email, address, payment details, etc.) is accurate. Failure to provide accurate information may result in suspension or termination of the account.

4. USER ACCOUNTS AND REGISTRATION DATA

  1. Users must register on the Website by providing accurate and complete information. Inaccurate or false information may result in suspension or cancellation of the account.
  2. Users grant the Company a non-exclusive, royalty-free, worldwide license to use the information provided for operational purposes. All such information is collected, used, stored and shared strictly in accordance with the Privacy Policy and applicable law, including the Digital Personal Data Protection Act, 2023.
  3. The Company is not responsible for issues arising from incorrect user-provided information.

5. ORDERS AND PAYMENTS

  1. An order placed through the Website or mobile application is an offer to purchase. A contract is formed only when the Company confirms the order.
  2. Prices are shown in Indian Rupees and are subject to change without notice until an order is confirmed. Applicable taxes are charged as required by law.
  3. The Company may decline or cancel an order where an item is unavailable, where a pricing or description error has occurred, or where the order appears fraudulent. Any amount already paid for a cancelled order is refunded.
  4. Payments are processed by third-party payment providers. The Company does not receive or store complete card or banking credentials.
  5. Returns, refunds and cancellations are governed by the Return and Refund Policy published on the Website, which forms part of these Terms.

6. COMMUNICATIONS, WHATSAPP AND AUTHENTICATION CODES

  1. By creating an account or placing an order, you agree to receive service communications relating to your account and orders by SMS, email and WhatsApp. These include authentication codes, order confirmations and delivery updates.
  2. Service communications are necessary to operate your account and are not marketing. Marketing messages are sent only where you have separately opted in, and you may withdraw that consent at any time.
  3. WhatsApp messages are delivered using the WhatsApp Business Platform operated by Meta. Your use of WhatsApp is also governed by WhatsApp's own terms and privacy policy.
  4. One-time passcodes are personal to you and must not be shared. The Company will never ask you for a passcode by phone, email or message. You are responsible for activity carried out using a code sent to your registered number or email address.
  5. You may opt out of WhatsApp messages at any time. Where you do, authentication codes will be sent by SMS or email instead. If you opt out of all channels, the Company may be unable to verify your identity and you may be unable to sign in.

7. USER RESPONSIBILITIES

  1. Users warrant that they own or have the right to share the information provided and that it is accurate, not misleading, and compliant with applicable laws.
  2. Users agree to indemnify the Company against claims arising from incorrect or inappropriate information provided.
  3. Users agree not to post or submit content that violates intellectual property or privacy rights; is defamatory, obscene, or unlawful; contains harmful code or viruses; or constitutes spam, solicitation, or unauthorized advertising.
  4. The Company reserves the right to remove or edit user-submitted content that violates these Terms.

  2. To the extent permitted by law, the Company is not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data.
  3. Where the Company is found liable in connection with an order, its total liability shall not exceed the amount paid by the User for that order.
  4. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, for fraud, or under the Consumer Protection Act, 2019. Your statutory rights as a consumer are not affected.

12. TERMINATION

The Company may suspend or terminate an account where the User breaches these Terms, provides false information, or uses the Website unlawfully or in a way that harms the Company or other users. You may close your account at any time, including through the account deletion page. Termination does not affect orders already placed, or any rights and obligations that arose before it.

13. PRIVACY AND DATA PROTECTION

Personal data is handled in accordance with the Privacy Policy published on the Website, which forms part of these Terms and explains what is collected, how it is used, who it is shared with, and the rights available under the Digital Personal Data Protection Act, 2023.

14. CHANGES TO THESE TERMS

Where a change is material, notice will be given through the Website before it takes effect. The "Last updated" date at the top of this page will always show the current version. Continued use of the Website after a change takes effect implies acceptance of the amended Terms.

15. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India. The courts at Delhi, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to any right a consumer has under law to bring proceedings elsewhere.
